Contemporary Issues in the Maritime, Shipping, and Shipbuilding Space: Common Sources of Disputes

Maritime, shipping, and shipbuilding industries play a crucial role in the global economy. These industries transport goods and resources across international waters, including goods and resources that may have geo-political implications and consequences should there be any supply chain disruptions, and their impact on national economies, including Vietnam, cannot be underestimated.

Vietnam’s status as an internationally recognised maritime gateway to mainland Asia and the region is unquestionable. Its coastline runs around 3,260 km from the north to the southwest. Operating along the various waterways are Vietnam’s major ports, which include Hai Phong, Quang Ninh, Ho Chi Minh City, and Ba Ria – Vung Tau. Vietnam plays a significant role in the maritime industry, ranging from transport to shipbuilding. In 2021, the total sea cargo throughput in Vietnam was estimated at 356.09 million metric tons.

In addition to its favorable location and government support, Vietnam also has a skilled and cost-effective labor force, making it an attractive destination for shipbuilding and repair companies looking to lower their production costs, and as an attractive port-of-call for not only Vietnam as a final destination for goods but also for goods with final destination going inland toward Vietnam’s neighboring countries

With the inherent risks in these industries, disputes are bound to arise which can potentially result in significant financial damages, liability, or losses to contracting parties.
